These Terms of Service ("ToS") govern access to and use of the Atako platform, available at atako.ai.
The platform is published by:

AIYBIZ develops, operates, and makes available, under the Atako brand, artificial intelligence agents for businesses and professionals ("Clients").
By using the platform, the User accepts these ToS in the version in force at the time of access, without reservation. Users must be an adult (18 years of age or older) acting in the course of their professional activity, or a legally registered entity. These ToS are addressed exclusively to professionals; see Article 16.
Registration requires the provision of accurate and complete information. The User is solely responsible for maintaining the confidentiality of their credentials and for all activities occurring under their account. Any suspicious or unauthorised use must be reported to AIYBIZ immediately at support@atako.ai.
Atako provides Clients with specialised artificial intelligence agents by business function (finance, development, sales, human resources, etc.). These agents are developed, operated, and maintained directly by AIYBIZ, each running in its own isolated virtual machine.
Agents may integrate with third-party tools used by the Client (as listed on the platform), subject to the Client expressly authorising each connection.
AIYBIZ uses all reasonable means to ensure the quality, security, and availability of Atako agents. The platform is accessible 24/7, subject to maintenance operations and events beyond AIYBIZ's control.
AIYBIZ offers a 14-day free trial, requiring no credit card, allowing up to 3 active agents to be activated and including 1,500 free credits. This trial is limited to a single activation per company and requires verification of the administrator account's phone number.
At the end of the trial period, if no paid subscription has been taken out, the Client's active agents are automatically paused and, absent a subscription during the retention period shown on the platform, permanently deleted. Unused free credits give rise to no compensation of any kind.
The free trial is provided "as is", with no contractual availability guarantee (see Article 11).
Access to Atako agents outside of the free trial requires a subscription to the Standard plan, billed per active agent, monthly or annually (the annual subscription being equivalent to two months free compared to monthly billing). The current pricing, as well as the number of credits included per agent per month, is set out on the platform's Pricing page.
Credits: each active agent grants a volume of included credits per month, which accumulate and never expire. The Client may purchase additional credits at any time or subscribe to a recurring credit plan. Credits are neither refundable nor convertible into cash, including upon cancellation of the subscription or termination of an agent.
Payment: payments are processed by Stripe and charged automatically according to the chosen frequency (monthly or annual). AIYBIZ does not store full credit card details.
Adding agents mid-period: adding active agents during a billing period is invoiced on a pro-rata basis for the remaining period, in accordance with the proration mechanism applied by Stripe.
Cancellation: the Client may cancel their subscription at any time from their account area. Cancellation takes effect at the end of the current subscription period; no pro-rata refund is made, unless otherwise required by mandatory law.
AIYBIZ reserves the right to modify its pricing with reasonable notice communicated by email or via the platform. Continued use of the platform after the effective date of new pricing constitutes acceptance.
All elements of the platform (interface, design, code, AI agents and their architecture, content, trademarks — including Atako —, logos) are the exclusive property of AIYBIZ and protected under applicable intellectual property laws.
AIYBIZ grants the Client a personal, non-exclusive, non-transferable, and non-sublicensable licence to access and use the service in accordance with these ToS.
Data and generated outputs: the Client remains the sole owner of the data it provides to the platform and of the results produced by Atako agents for its own purposes ("Outputs"). Subject to full payment of subscription fees, AIYBIZ grants the Client a non-exclusive licence to use these Outputs for their professional or personal purposes. As the legal status of AI-generated content continues to evolve, this licence is granted within the limits permitted by applicable law.
Promotional licence: the Client authorises AIYBIZ to mention their name and logo as a commercial reference in its Atako-branded communications, unless the Client objects in writing.
Technical confidentiality: system prompts, reasoning logic, internal configuration parameters, AI agent orchestration architectures, as well as credentials, API keys, authentication tokens, and other technical secrets used by AIYBIZ or its providers (including third-party AI model providers) to operate the Atako Solution constitute confidential information and trade secrets of AIYBIZ within the meaning of Article L.151-1 of the French Commercial Code. The Client shall not attempt to access, extract, reconstruct, or disclose these elements by any means whatsoever.
It is forbidden to use the platform or the agents to:
AIYBIZ reserves the right to suspend or terminate any account in breach of these rules, without notice or refund in the event of a serious violation.
Good-faith reporting: the above provisions do not apply to persons who identify a security vulnerability in good faith and promptly report it to AIYBIZ at support@atako.ai, without exploiting the flaw beyond what is strictly necessary to demonstrate it, without deriving any personal benefit from it, and without disclosing its details to third parties before it is fixed.
Monitoring and logging: AIYBIZ may monitor use of the platform and log technical events, including suspicious attempts referred to in this article, for security, fraud-detection, and compliance purposes, in accordance with its Privacy Policy.
In the event of a breach of the provisions of Article 8 relating to the extraction of proprietary data or the misuse of technical keys, and without prejudice to the sanctions set out in Article 14:
Atako agents rely on artificial intelligence models whose outputs are probabilistic in nature and may contain errors, approximations, or inaccuracies. AIYBIZ does not guarantee the accuracy, completeness, or relevance of the results produced by the agents.
It is the Client's responsibility to exercise reasonable human oversight over the results produced by the agents before relying on them for any use, decision, or action, in particular where such results carry a significant legal, financial, or operational impact, or are difficult to reverse.
As an operator and deployer of artificial intelligence systems, AIYBIZ commits to complying, for the Atako platform, with its obligations under the EU Artificial Intelligence Act, in particular regarding transparency, human oversight, and risk management, according to the classification applicable to each agent.
AIYBIZ uses its best efforts to ensure continuous availability of the platform, without however guaranteeing uninterrupted access or committing to any contractual service-level agreement (SLA), in particular during the free trial period referred to in Article 5.
Support is available by email at support@atako.ai and via the assistant built into the platform, at the hours and under the conditions indicated on the platform.
Data processing is carried out in accordance with the GDPR and Atako's Privacy Policy, available on the platform.
AIYBIZ does not guarantee uninterrupted access to the platform. Its liability for direct damages arising from a proven malfunction of the platform is limited to the total amounts paid by the Client in the twelve (12) months preceding the event giving rise to the damage.
AIYBIZ shall not be held liable for indirect damages, including but not limited to data loss, loss of business, loss of revenue, or commercial harm resulting from the use or inability to use the platform, nor for decisions made by the Client based on results produced by the agents.
These limitations apply exclusively in the context of business-to-business (B2B) relationships. They do not apply to damages caused by AIYBIZ's intentional misconduct or gross negligence, nor to amounts owed by the Client under Article 8 bis.
AIYBIZ may suspend or terminate a Client's access, with or without notice depending on the severity of the facts, in particular in the event of: non-payment of amounts due, breach of these ToS (in particular Articles 8 and 8 bis), or abusive or fraudulent use of the platform.
The Client may cancel their subscription at any time under the conditions set out in Article 6.
AIYBIZ may modify these ToS at any time. Modifications are notified by email or via the platform. Continued use of the platform after the effective date of the modifications constitutes acceptance of the updated ToS.
These ToS are governed by French law. In the event of a dispute, and following an attempt at an amicable resolution, exclusive jurisdiction is granted to the competent courts of Paris.
These ToS are addressed exclusively to professionals (legal entities or natural persons acting in the course of their professional activity). Consumer protection law, and in particular the consumer mediation scheme provided for in Articles L.616-1 et seq. of the French Consumer Code, does not apply to them.
