3. Hosting

3.1 Website. The Website is hosted by Google Cloud EMEA Limited, 70 Sir John Rogerson's Quay, Dublin 2, Ireland.

3.2 Platform Data. User accounts, agent names, messages exchanged between users and agents or between agents, session messages and settings are hosted in the European Union by one of the providers referred to in Section 3.3.

3.3 Agent Virtual Machines. Agents run in virtual machines provided by one of the following providers. Atako is free to choose the provider and the hosting region of each virtual machine; that region is not guaranteed and may be located outside the European Union.

3.4 On-Premises Version. Offered upon request to Atako's sales team, it is installed on the customer's infrastructure, and the customer is responsible for hosting it.

4. Purpose of the Platform

Atako is a service intended for professionals. It enables them to deploy and supervise persistent artificial intelligence agents that work alongside their teams. Atako provides an agent image, which it instantiates in a dedicated virtual machine; the customer alone defines the role, instructions and permissions of each of its agents, and is answerable for the use made of them. The Platform is built on three distinct layers:

the Atako layer, developed and operated by AIYBIZ: interface, human notices, projects, company context layer, agent images, instantiation, securing and technical supervision of the agents;
open-source harnesses, the agents' execution engines, developed by third parties;
artificial intelligence models provided by third parties, which the agents access either through the inference offered by Atako or through the API key of the provider chosen by the customer.

5. Intellectual Property: The Atako Layer and the Open-Source Engines

5.1 The Atako Layer. With the exception of the components referred to in Sections 5.2 and 5.3, the Website and the Platform — including, in particular, their code, their interfaces, the agent images prepared by AIYBIZ, databases, texts and graphic elements — as well as the Atako trademark and its logos are the exclusive property of AIYBIZ or its licensors. They are protected by the French Intellectual Property Code. Any unauthorized reproduction, representation, modification or exploitation is prohibited.

5.2 The Open-Source Harnesses. Atako provides agent images that it prepares, secures, tests and maintains, and instantiates them in dedicated virtual machines; the customer defines the role and instructions of each of its agents. Each image runs on a recognized open-source harness — Hermes Agent (© Nous Research), OpenClaw (© OpenClaw Foundation) or OpenCode (© opencode) — which we integrate, secure and keep up to date. One agent, whatever the harness. These harnesses are not developed by AIYBIZ: they remain the property of their authors and are distributed under the MIT License. The list of components, their versions and the text of their licenses are provided upon request sent to support@atako.ai.

5.3 The AI Models. The agents use artificial intelligence models provided by third parties, either through the inference offered by Atako and paid for in credits, or through the provider chosen by the customer, using the customer's own API key. These models are neither developed nor trained by AIYBIZ. The terms of each model's provider are accessible in the Platform when the model is selected; they describe, in particular, how that provider uses the data transmitted to it.

5.4 Third-Party Trademarks. Hermes Agent, OpenClaw, OpenCode and the names of the providers mentioned are trademarks or names of their respective owners. They are mentioned solely to identify the components and services used; such mention implies neither partnership nor endorsement.

6. Website Content

The information published on the Website is provided for informational purposes only. The conditions for use of the Platform, including the allocation of responsibilities between Atako and its customers, are governed by the Terms of Use and Sale.

8. Point of Contact and Reporting of Illegal Content

AIYBIZ has designated a single point of contact for authorities and users: dsa@atako.ai, in French or English. Any illegal content hosted on the Platform may be reported to this address, stating the reasons for the report, the exact location of the content, the name and email address of the person submitting the report, and a statement of good faith.

9. Language and Governing Law

This Legal Notice is drafted in French. In the event of translation, only the French version shall be authoritative. It is governed by French law. Disputes relating to the use of the Platform are subject to the provisions of the Terms of Use and Sale.
